Arlington police have charged a 60-year-old homeless man after he was found sleeping inside Broadway Dunkin’ Donuts early Sunday, Jan. 15.
Stephen C. Duffey was charged with breaking-and-entering and as a fugitive from justice on a court warrant in the 4:43 a.m. incident at North Union and Broadway.
In a report, police describe what took place following a report of someone inside the shop building before it had opened.
On arrival, officers spoke with a frightened person while a man, later identified as Duffey, could be seen through a window seated in the far corner of the store. No lights were on inside as police were let into the shop.
Police said the two officers announced their presence to Duffey, who was sleeping. Police checked the rest of the store and confirmed no one else was there.
Duffey was awakened, and the report says police could clearly smell the odor of alcohol. He said he believed Dunkin’ Donuts was open and was just waiting for a cup of coffee. He said that when he walked in, the door was unlocked, the lights were on and the music was playing.
Police said that when they entered, music was playing, but the lights were off.
Duffey provided his license and, after running a check on it, dispatch said had an active default warrant.
Police confirmed that nothing in the shop had been disturbed or taken. A witness told police that, because the doors had been locked, it was possible Duffey gained entry when the delivery man opened the doors.
Duffey was subsequently arrested, searched, handcuffed (double locked) and transported to the station, where he was booked.
The court warrant was issued Jan. 12 for operating under the influence (third offense), reckless operation of a vehicle and leaving the scene.
Duffey’s criminal history has 13 entries, including operating under the influence , assault and battery and disorderly conduct.
